The Regulator is appointed under Schedule 2 Part 1 of the Work Health and Safety Act 2012 and is to perform the functions imposed, and exercise the powers conferred, on the Regulator under the Work Health and Safety Act or any other Act.
The current Regulator is Sam Thompson, Executive Director of WorkSafe Tasmania.
The following information is from Part 8 of the Work Health and Safety Act 2012.
Functions of the Regulator
The regulator has the following functions:
- to advise and make recommendations to the Minister and report on the operation and effectiveness of this Act
- to develop, implement and review strategies and plans for improving work health and safety
- to monitor and enforce compliance with this Act
- to provide advice and information on work health and safety to duty holders under this Act and to the community
- to collect, analyse and publish statistics relating to work health and safety;
- to foster a cooperative, consultative relationship between duty holders and the persons to whom they owe duties and their representatives in relation to work health and safety matters
- to promote and support education and training on matters relating to work health and safety
- to engage in, promote and coordinate the sharing of information to achieve the object of this Act, including the sharing of information with a corresponding regulator
- to conduct and defend proceedings under this Act before a court or tribunal
- any other function conferred on the regulator by this Act.
Powers of the Regulator
The Regulator has the power to do all things necessary or convenient to be done for or in connection with the performance of its functions. They have all the powers and functions that an inspector has under this Act.
