Terms and conditions

1 In these terms and conditions, ‘WorkSafe Tasmania’ means the Crown in Right of Tasmania represented by WorkSafe Tasmania, a division of the Department of Justice.

2 The WorkSafe Tasmania Awards (WorkSafe Awards) are administered by WorkSafe Tasmania for and on behalf of the WorkCover Tasmania Board.

3 These terms and conditions apply to all entrants and categories for the WorkSafe Awards.

4 By submitting an entry, entrants shall be taken to have acknowledged and accepted these terms and conditions and have agreed to be bound by them.

5 Entrants who breach any of these terms and conditions will be subject to disqualification.

Submission requirements

6 Entries will only be accepted through the online awards entry form.

7 WorkSafe Tasmania reserves the right to reject incomplete entries.

8 More than one entry may be submitted by an individual or organisation in the same category, however, each entry must relate to a separate person, initiative or solution.  The same initiative or solution may, however, be entered in multiple categories.

9 Each award category has its own criteria.  Entrants must address the criteria relevant to the category for which they seek to be considered for an award.

10 Entries dealing with scientific, medical or technical achievements should be accompanied by a summary in plain English or ‘lay’ terms.

11 Each entrant must confirm that their entry, including any designs and/or inventions, is the entrant’s original work and that any intellectual property rights arising in connection with that entry does not infringe any third-party rights.

12 Additional material may be supplied at time of entry to assist in demonstrating claims to the category criteria.  This could include, but is not limited to, Workers’ Compensation claims and incident/injury data and other work health and safety reporting information, photographs, videos and links to visual media.

13 Each entry must provide a high-resolution image of their organisation’s logo and authorise its use by WorkSafe Tasmania.

14 Entrants must confirm that all information in their entry is true, accurate and complete at the time of submission.

15 Once an entry has been submitted, it cannot be amended.

16 Entries and supporting material will not be returned.

17 The closing date for entries for the WorkSafe Awards is 11.59pm on Sunday 3 June 2018.

18 Late entries will not be accepted, unless otherwise approved by WorkSafe Tasmania, at WorkSafe Tasmania’s absolute discretion.

20 Winners will be announced at an awards presentation held during WorkSafe Tasmania month.

Eligibility

21 Entry is open to individuals, associations, partnerships, companies and other organisations operating within Tasmania; WorkSafe Tasmania and their employees are not eligible to participate.

22 Sponsors and those representing an organisation on a judging panel are ineligible to enter the WorkSafe Awards.

23 Past WorkSafe Award winners must not base their entry on the same or similar initiative as their previous award-winning entry.

24 Entries that do not comply with legislation administered by WorkSafe Tasmania may not be eligible.  A comprehensive list of legislation administered by WorkSafe Tasmania may be found at www.worksafe.tas.gov.au/laws

25 If asked, entrants must provide evidence they hold insurance, and have paid all fees, required by law, or otherwise appropriate, for the conduct of their day-to-day activities

26 Entrants (including directors) must disclose if they:

  1. have had a workplace fatality in any workplace for which they are responsible.
  2. have been prosecuted for any offence by WorkSafe Tasmania.
  3. are currently the subject of investigation or prosecution by WorkSafe Tasmania.

27 WorkSafe Tasmania reserves the right to decline, accept, or disqualify an entry at its absolute discretion, including, but not limited to, situations in which the entrant, or a related person or organisation, has breached or is under investigation for possible breaches of work health and safety laws (whether or not a prosecution is pending), or where the acceptance of the entry may otherwise be detrimental to the objectives of the WorkSafe Awards.

Judging

28 Entrants may be asked to verify their entries by way of validation.

29 WorkSafe Tasmania reserves the right to consider an entry under any of the various award categories. This may occur without the consent of the entrant; however, entrants will be kept informed of any category changes to their entry.

30 WorkSafe Tasmania reserves the right not to allocate an award in a particular category where, in its opinion, there are no entries of sufficient merit.

31 In the event that an entrant is judged to have won a category and is found to have failed to satisfy or abide by the terms and conditions of the WorkSafe Awards, that entrant will not be entitled to the relevant award. WorkSafe Tasmania may, at its absolute discretion, award the relevant award to another entrant or choose not to award the award at all.

32 The decision of WorkSafe Tasmania is final and no correspondence will be entered into.

Personal Information Protection

33 Information is collected, used, disclosed and handled in accordance with the Personal Information Protection Statement (PIP) statement, accessible from the WorkSafe Tasmania website, and the Personal Information Protection Act 2004 (Tas). Individuals have the right to access personal information WorkSafe Tasmania holds about them. To do so, please contact our Helpline on 1300 366 322.

34 WorkSafe Tasmania will ensure that there is no disclosure to any third party of any information provided by an entrant and marked ‘confidential’, except with the prior consent of that entrant or where such a disclosure is authorised or required by law.

35 All entrants authorise WorkSafe Tasmania to use the information contained in entries, including (but not limited to) contact names, phone numbers and photos for any purposes WorkSafe Tasmania see fit.

36 WorkSafe Tasmania will not use the personal information of entrants for any other purpose without the prior consent of the entrant, or unless authorised or required to do so by law.

General provisions

37 The assessment, conduct and results of the awards do not create any legal obligations between entrants, WorkSafe Tasmania and the Crown in Right of Tasmania.

38 Winning an award does not signify endorsement of a particular product or a particular health and safety practice by WorkSafe Tasmania

39 In the event of any inconsistency between any information provided by WorkSafe Tasmania in relation to the WorkSafe Awards these terms and conditions will prevail, followed by the online entry form, other information available on the website and any other relevant material, in that order.

40 Entrants acknowledge that they may be requested to participate in presentations and media interviews in respect of their entry and agree to take all reasonable steps to make themselves available for, and actively participate in, such presentations or media interviews.
